GENERAL TERMS AND CONDITIONS OF USE

The main activity of CHARGEPRICE (hereinafter referred to as ‘we’ or ‘us’) is the operation of a platform for geolocating electric vehicle charging stations and comparing charging prices.

1. PURPOSE OF OUR TERMS OF USE

 

We operate the ‘chargeprice’ web application and the “chargeprice” mobile application, which can be deployed in Android and iOS environments (referred to as ‘our applications’), on which we provide a platform for geolocating electric vehicle charging stations and comparing charging prices (referred to as ‘our platform’).

 

The purpose of these terms and conditions of use (referred to as ‘our T&Cs’) is to define the terms and conditions of use of our platform.

 

2. SCOPE OF APPLICATION OF OUR T&Cs

 

Our T&Cs are agreed between any user of our platform (referred to as ‘you’) and us, for any use of our platform. 

 

In all cases where you wish to use our platform, our T&Cs apply. 

 

Our T&Cs may be supplemented by our general subscription terms and conditions or our general terms and conditions of service (professionals), depending on your choice. Together, they express the entirety of our mutual obligations, to you and to us, concerning the terms and conditions of use of our platform, i.e. you cannot invoke any other document or agreement entered into prior to the conclusion of the contract, even if we have exchanged verbal or written communications beforehand.

 

Please read this document carefully. In order to use our platform, you must read and accept our Terms of Use without reservation, i.e. without modifications, additions or deletions. 

 

3. MODIFICATION OF OUR TERMS OF USE

 

We may modify our Terms of Use at any time. You will be notified of any changes via an announcement on our applications. 

 

If you have registered on our platform and do not agree with the new version of our Terms of Use, you may delete your user account. You will then no longer be able to use our service. If you continue to use our platform even after the new version of our Terms of Use has come into effect, we will consider that you have accepted this version.

 

4. DESCRIPTION OF OUR SERVICE

 

Our platform allows users to list and geolocate publicly accessible electric vehicle charging stations and compare charging prices per station. The list of countries for which listing is possible is available on our platform and is regularly updated.

 

Our platform is enriched by user contributions. If you notice that a price is inaccurate or you spot a charging station that is not listed on our platform, you can modify the corresponding data directly on our applications.



5. DATA OWNERSHIP

Authorisation to access our databases does not imply the transfer of any ownership rights over the data contained in these databases, which remain our sole property. It is prohibited to resell the data accessible on our platform to third parties without our authorisation.

All data accessed as part of a demonstration, test, evaluation, audit or in any other case where our GTC or GTCS do not apply is strictly confidential and may not be disclosed to third parties for any reason whatsoever.

IF YOU ARE A PROFESSIONAL: In the event of non-compliance with these prohibitions, you shall be liable for compensation in the amount of €25,000.00 (TWENTY-FIVE THOUSAND EUROS).

6. LEVEL OF SERVICE

You are responsible for all costs associated with the purchase, installation, maintenance and connection of the various means of telecommunication necessary to access our application.

We are solely authorised to perform or arrange for corrective maintenance of our application. You may report any connection or usage anomalies to us.

We reserve the right to upgrade our application through updates. Some updates will be corrective in nature, while others will be evolutionary, in particular to improve our application or to keep it compliant with applicable regulations.

We inform you that access to our application may be temporarily interrupted in the event of maintenance or updates. You will be informed of this by a notification on the home page of our application.

Please note that the Internet network is subject to technical hazards that may affect the use of our application.

7. YOUR OBLIGATIONS

By using our platform, you must:

use our platform in a lawful manner, i.e. in accordance with the laws and regulations in force and in accordance with our Terms of Use,

use our platform in accordance with its intended purpose, i.e. for the purpose of searching for electric vehicle charging stations and comparing charging prices.

If you wish to modify data accessible on our platform, you must provide accurate data. The reliability and quality of our service also depend on your contributions.

Furthermore, it is prohibited to:

use an automated process, programme or tool, applet, bot or robot or similar to access our platform, use a data mining system when using our platform for any purpose whatsoever, including downloading content, indexing, extracting or caching any content from our platform,

disrupt the normal functioning of our site or application and/or interfere with our platform, including by downloading computer viruses, overloading, flooding, spamming, mail bombing or crashing,

use our platform for fraudulent or illegal purposes,

extract, copy and/or reuse the data on our platform for commercial purposes without our prior consent.

8. OUR LIABILITY

The data concerning the charging stations accessible on our platform is partly provided directly by users. We cannot guarantee that it is complete and accurate.

We cannot be held liable if the damage is entirely caused by your negligence or fault, by the unforeseeable and insurmountable actions of a third party, or in the event of force majeure. Force majeure refers to any external, unforeseeable and irresistible event within the meaning of Article 1218 of the Civil Code and as defined by case law.

Our application is a standardised IT solution that has not been developed for the needs of a particular user.



9. INTELLECTUAL PROPERTY

Nothing in this document authorises you to use the intellectual property assets present on our applications or in our documentation.

All text, images, logos and graphical interfaces on our applications and in all our documentation, as well as the IT component of our applications (software and its documentation), are protected by copyright worldwide. It is therefore prohibited for any person to copy, modify, distribute, transmit, broadcast, represent, reproduce, publish, license, transfer or exploit in any other way the aforementioned elements, as all such uses are likely to constitute an infringement.

It is prohibited to modify the source code of our applications in any way and for any reason, including to correct errors or anomalies, as maintenance is managed by us.

The content of our platform’s database is protected by the sui generis right of the database producer. In accordance with Article L. 342-1 of the Intellectual Property Code, we prohibit anyone from extracting and reusing the content of this database without our authorisation.

We oppose any text and data mining operations within the meaning of Article L. 122-5-3 of the Intellectual Property Code, including in particular the automated search, downloading and analysis of data for our entire platform, its content and the data contained therein and protected by copyright.

It is prohibited to modify or attempt to circumvent any technical protection measures applied to our website or application.

Anyone who fails to respect these intellectual property rights may be subject to legal proceedings.

10. COMPLAINTS

For any complaints, you can contact us by post or email. If you do not receive a response from us within seven (7) days if you have contacted us by email, or one (1) month if you have contacted us by post, please consider that we have rejected your complaint.

11. LANGUAGE OF THE CONTRACT

The English version of our Terms of Use is authoritative and prevails over any other version in a language other than English, particularly in the event of any contradiction or difference in interpretation. Any version of our Terms of Use provided in a language other than English is for informational purposes only.

12. APPLICABLE LAW

The law applicable to our Terms of Use (and to any contract governed by them) is French law.

If you are a consumer, this choice of law does not deprive the mandatory provisions of the law of the country where you have your habitual residence of their effect (Regulation 593/2008/EC, Article 6, point 2).
